Kyle Sandilands has started legal action against ARN Media following the axing of the Kyle and Jackie O show.
The proceedings in the Federal Court are filed against ARN and its subsidiary Commonwealth Broadcasting Corporation, the licence holder for KIIS 1065 Sydney.
Documents filed with the court claim the termination of Sandilands’ contract was invalid on the basis that there was no act of serious misconduct or breach of contract.
The action alleges that the termination was unconscionable under Australian Consumer Law.
Sandilands seeks an order for specific performance of two contracts, payment of whatever amounts are due and payable under the contracts at the time of judgment, and damages.
"ARN disputes the claims," the company told the ASX.
"It intends to defend the proceedings.
"Given the early stage of the matter, ARN is unable to reliably estimate the outcome or any potential financial impact."
ARN last week issued a notice of termination of contract to Sandilands and his company Quasar Media Services.
“As a result, the Kyle and Jackie O show will no longer be presented,” the company then said in a notice to the ASX.
This decision follows written notice stating that Sandilands’ behaviour constitutes “serious misconduct” and a breach of the services agreement.
From March 3, Sandilands was given 14 days to remedy the breach.
Jacqueline Henderson, the other half of the show, had given notice that she “cannot continue to work with Mr Kyle Sandilands”.
The Australian Communications and Media Authority has imposed additional licence conditions on ARN Media following breaches of the decency provision of the Commercial Radio Code of Practice nine times in 2025 over the Kyle and Jackie O Show.
